There are four signatures required before a contract is valid. The signatures are:
NOTE: If work begins under a contract BEFORE it is valid, the college, university, or System Office is in violation of the law (MS 16A.15). The college, university, or System Office must prepare and get approval of MnSCU form 019 (16A.15 Form) where the employee explains why the law was violated and how the circumstance will be avoided in the future. Any work done before a valid contract exists is subject to being denied by the Legislative Auditor and the contractor would have to return any funds paid.
If working on a contract, and the effective date is very close, include with the contract documents a memo that states NO WORK WILL BEGIN UNDER THE CONTRACT until it is fully executed. This will save time and clearly indicate that the college, university, or System Office is aware of and in control of the situation.
